Tracy Morgan is out of the hospital after a deadly car accident and is now heading to court. The crash involving an 18-wheeler and six cars including the star’s limo bus killed one person and critically injured four others.
The “30 Rock” and “Saturday Night Live” star is suing Walmart and the truck driver for damages caused due to the deadly crash. The suit accuses Walmart of negligence for allowing their driver to go 700 miles without sleeping for 24 hours.
“As a result of Wal-Mart’s gross, reckless, willful, wanton, and intentional conduct, it should be appropriately punished with the imposition of punitive damages,” read the complaint.
The comedian suffered broken ribs and a broken leg in the crash. Three other passengers were also injured and the comedian’s friend and mentor James McNair was killed.
Kevin Roper, the driver of the Walmart truck, turned himself in and has pleaded not guilty to death by auto and assault charges. Federal Transportation safety investigators said Roper was working for 13 and a half hours when his car slammed into Morgan’s limousine. Federal rules allow drivers to work for 14 hours a day with a maximum of 11 hours behind the wheel. He was also driving 65 mph in a construction zone that had a lowered speed limit of 45 mph.
Morgan and team were driving back to New York from a standup performance at Dover Downs Hotel & Casino in Delaware when the crash happened near Cranbury, NJ.
